Italy’s Supreme Court Recognizes Fascist Salute as Legal

The Roman greeting, which among other things was used in Nazi Germany, is illegal only if it carries risks of revival of the fascist party, the Supreme Court of Cassation of Italy has decided, RAI TV channel reports.

The TV channel notes that he made his decision while considering a case related to the events of 2016. Then at the demonstration several participants used this greeting, which led to charges of attempting to rehabilitate fascism. Eight people were convicted but appealed the judgement. The Supreme Court decided to hear the case again.

“Obviously, the fascist salute is an affront to individual feelings” but it becomes an offence “when it poses a concrete threat to public order”, prosecutor Pietro Gaeta told the court, he was quoted as saying by Il Fatto Quotidiano.

The newspaper notes that the court ruled that the use of such a greeting in private or at commemorative events should not be considered a threat.

As RAI writes, a few days in Rome in another commemorative action, several participants also used the Roman greeting, and an investigation was launched against them. However, a court ruling put an end to the controversy arising from this situation.
